8. Account Security

Customers should use passwords that are reasonably strong and unique. You should not share your customer password with unauthorized persons.

Security Reminder: Sunrise Garden Center will never ask you to provide a complete payment-card number, CVV/CVC/CID security code, PIN, or online-banking password through ordinary email. Suspicious communications claiming to be from Sunrise Garden Center should be verified through contact information published directly on sunrisegarden.site.

9. Electronic Communications

By using the Website, submitting an order, creating an account, or contacting Sunrise Garden Center electronically, you consent to receiving transactional electronic communications reasonably necessary to administer your request or transaction.

These communications may include order confirmations, payment notifications, fraud-verification requests, shipping notifications, delivery updates, cancellation notices, refund communications, account-security notifications, or customer-service messages.

Transactional communications are separate from promotional marketing communications. Where Canadian anti-spam legislation (CASL) applies to commercial electronic marketing, Sunrise Garden Center should obtain and maintain appropriate consent and provide required identification and unsubscribe functionality. Canadian government guidance states that CASL generally requires consent for commercial electronic messages and requires unsubscribe requests to be actioned within the applicable period.

10. Product Categories

Sunrise Garden Center may offer products including, but not limited to:

Vegetable seeds, herb seeds, flower seeds, microgreen seeds, bulk seeds, seed assortments, growing supplies, soils, fertilizers, plant foods, mulches, seed-starting supplies, gardening accessories, and other lawful garden or agricultural products.

Available product categories may change without notice. The availability of a product on the Website does not guarantee permanent availability.

11. Product Information

Sunrise Garden Center makes reasonable efforts to provide accurate and understandable product information. Product descriptions may include variety, size, quantity, weight, growing characteristics, planting information, packaging, intended use, photographs, availability, and other information.

Natural products and agricultural materials may vary in appearance. Photographs are intended to provide a reasonable representation of the product but may appear different depending on screen settings, crop, lighting, production batch, packaging revision, seasonal variation, or other reasonable factors.

Sunrise Garden Center should not intentionally use materially misleading photographs or descriptions. The Competition Bureau advises businesses not to use product photographs or illustrations that materially differ from what is actually being sold.

12. Seeds and Natural Agricultural Products

Seeds are biological and agricultural products. Seed performance may vary because of environmental and cultivation conditions beyond the control of Sunrise Garden Center.

Factors affecting germination, establishment, growth, yield, colour, flavour, maturity, or plant performance can include soil condition, moisture, irrigation, temperature, light, planting depth, fertility, growing medium, climate, storage, pests, disease, weather, transplanting methods, agricultural practices, and other environmental conditions.

Unless an express written germination or product warranty states otherwise, general planting or growing information is intended as guidance rather than a guarantee of a particular growing result. Nothing in this section limits any mandatory legal warranty or consumer right.

13. Growing Information

Planting dates, germination periods, harvest periods, spacing, planting depth, growth characteristics, hardiness information, and other growing recommendations may be estimates.

Customers should consider their local climate, growing zone, weather conditions, applicable agricultural guidance, and individual growing conditions. A planting recommendation that is appropriate in one part of Canada may not be appropriate in another region.

Sunrise Garden Center does not guarantee that generalized educational information will produce identical results in every environment.

14. Agricultural and Import Restrictions

Certain seeds, soil materials, plant products, fertilizers, agricultural goods, or other gardening products may be restricted in particular provinces, states, territories, countries, or agricultural zones.

Availability on the Website does not automatically mean that every product may lawfully be shipped to every location. Sunrise Garden Center reserves the right to decline or cancel a shipment when it determines that a product cannot lawfully or reasonably be shipped to the requested destination.

International customers are responsible for complying with applicable import requirements unless Sunrise Garden Center expressly agrees in writing to handle a particular requirement.

15. Product Availability

All products are subject to availability. Inventory levels may change rapidly. A product displayed as available may become unavailable because of inventory discrepancies, supplier issues, damaged inventory, seasonal availability, order volume, technical errors, or other circumstances.

If Sunrise Garden Center cannot fulfill an ordered product, it may contact the customer and, depending on the circumstances: offer an approved substitute, place an item on backorder with the customer's consent, partially fulfill an order, cancel the affected product, or issue an appropriate refund.

A materially different substitute should not be shipped without customer approval.

16. Pricing

Sunrise Garden Center intends to display accurate product pricing. Unless otherwise expressly stated, Website prices should be displayed in Canadian Dollars (CAD).

Applicable sales taxes and permitted variable delivery costs may be calculated during checkout according to the destination and transaction.

Sunrise Garden Center should not intentionally impose undisclosed mandatory non-government fees after advertising an otherwise unattainable price. Canadian Competition Bureau guidance states that advertised prices should be attainable and identifies mandatory hidden non-governmental fees as potentially unlawful drip pricing.

17. Sale and Promotional Pricing

Discounts, promotional prices, coupon codes, quantity discounts, introductory offers, and other promotions may be subject to stated conditions and expiration periods.

Where Sunrise Garden Center represents a price as discounted from a regular or ordinary selling price, the reference price should be genuine and supportable. The Competition Bureau states that businesses should not create artificial regular prices merely to make a promotional discount appear greater than it actually is.

Sunrise Garden Center may correct an obvious pricing error before accepting or fulfilling an affected order, subject to applicable law.

18. Taxes

Customers are responsible for applicable taxes imposed on their transaction. Sunrise Garden Center will collect and remit sales taxes where required.

Applicable taxes may include GST, HST, PST, or other taxes depending on the products, destination, and applicable law. Where required, tax amounts will be identified during checkout or on the customer's transaction documentation.

19. Errors in Website Information

Despite reasonable efforts, the Website may occasionally contain typographical errors, incorrect descriptions, technical errors, pricing errors, outdated availability information, broken links, or other mistakes. Sunrise Garden Center may correct errors when discovered.

If an error materially affects an order already submitted, Sunrise Garden Center will take reasonable steps to communicate with the customer before fulfillment or provide an appropriate cancellation or refund where required.

Nothing in this provision authorizes Sunrise Garden Center to engage in misleading advertising or disregard non-waivable consumer rights.

20. Online Orders

Submitting an order through the Website constitutes an offer by the customer to purchase the identified products under the applicable terms.

Receipt of an automated order confirmation does not necessarily mean the order has completed all fraud, inventory, payment, or fulfillment review. Sunrise Garden Center may reasonably review an order before final acceptance or shipment.

Order review may include inventory confirmation, payment authorization, address review, fraud screening, product restrictions, and other legitimate fulfillment controls.

21. Required Internet Sales Information

For applicable Alberta consumer internet transactions, Sunrise Garden Center should provide required information clearly before the customer enters into the contract.

Alberta's Internet Sales Contract guidance identifies information such as the business name, address and telephone number; product description; itemized pricing and associated costs; taxes and shipping; potentially applicable additional charges; currency; payment terms; cancellation/return/refund policies; delivery arrangements; and other material conditions. It also states that customers should have an opportunity to accept or decline the transaction and correct errors immediately before entering into it.

Sunrise Garden Center's checkout should therefore present accurate order details before the customer submits payment.

22. Order Confirmation and Contract Copy

Where required by applicable law, Sunrise Garden Center will provide customers with appropriate electronic documentation of their completed transaction.

Order documentation may include the customer's name, order date, order number, purchased products, prices, taxes, shipping charges, total transaction amount, payment information summary, delivery information, and applicable terms. Customers should retain their confirmation for their records.

Alberta guidance states that qualifying internet sellers must provide consumers with a copy of the internet sales contract in writing or electronic form within the prescribed period.

23. Correction of Checkout Errors

Before submitting an order, customers should be provided a reasonable opportunity to review and correct relevant information, including product selection, quantities, shipping address, billing information, shipping method, and order total.

Customers are responsible for reviewing their order before final submission. Where a customer discovers an error after submission, Sunrise Garden Center should be contacted promptly. Changes cannot always be guaranteed after an order enters fulfillment.

24. Payment Authorization

Payment methods available for a particular purchase are displayed during checkout. Submission of payment information authorizes the applicable payment provider to process the transaction according to its rules and the customer's agreement with that provider.

A payment authorization may occur before shipment. Payment authorization does not by itself mean that the order has been packed or dispatched.

25. Secure Payment Processing

Sunrise Garden Center uses secure electronic checkout processes and may rely on authorized third-party payment processors. Payment information may be transmitted directly to a payment processor rather than stored by Sunrise Garden Center.

Sunrise Garden Center does not intentionally retain payment-card security codes such as CVV, CVC, or CID after authorization. Customers should review the separate Payment & Security Policy for additional information about payment security and fraud-prevention procedures.

26. Fraud Prevention

Sunrise Garden Center may conduct reasonable transaction verification to protect customers and the business. Verification may consider billing information, shipping information, payment authorization, transaction amount, purchase history, order quantity, customer contact information, fraud-screening information made available by service providers, requests for post-payment shipping changes, and other transaction-risk indicators.

Additional identification or business verification may be requested for unusual, commercial, bulk, wholesale, or high-value orders where reasonably necessary. Sunrise Garden Center may decline or cancel a transaction reasonably believed to be fraudulent, unauthorized, prohibited, or unverifiable.

27. High-Value Transactions

Large bulk, wholesale, freight, institutional, or commercial orders may be subject to enhanced verification. Sunrise Garden Center may verify the purchaser, business identity, delivery location, authorized representative, payment authorization, shipping requirements, or other reasonable information.

Additional fulfillment controls may include insured shipping, signature confirmation, freight documentation, delivery receipts, or direct customer confirmation. These procedures are designed to reduce payment fraud, unauthorized purchases, delivery disputes, and chargebacks.

28. Order Cancellation by Sunrise Garden Center

Sunrise Garden Center may cancel all or part of an order where reasonably necessary because of suspected fraud, unauthorized payment activity, inventory unavailability, pricing errors, incorrect product information, shipping restrictions, destination restrictions, failure of payment authorization, inability to verify a transaction, legal requirements, or other legitimate fulfillment issues.

Where payment has already been captured for a cancelled product, an appropriate refund will ordinarily be issued to the original payment method.

29. Customer Cancellation

Customers wishing to cancel an order should contact Sunrise Garden Center promptly. An order that has not yet entered final fulfillment may be cancellable according to the applicable cancellation policy.

Once an order has shipped, the transaction will generally be handled under the Returns & Refunds Policy rather than as an unshipped cancellation. Mandatory statutory cancellation rights remain unaffected.

30. Alberta Consumer Rights

Nothing in these Terms eliminates rights provided under Alberta's Consumer Protection Act where that legislation applies.

Alberta states that consumers cannot waive protections under the Consumer Protection Act and may have cancellation or other remedies in specified circumstances, including certain internet transactions.

Accordingly, any provision of these Terms that conflicts with a non-waivable statutory consumer right will apply only to the maximum extent legally permitted.

31. Shipping and Delivery

Shipping is governed by the Sunrise Garden Center Shipping & Delivery Policy. Available shipping methods, processing times, delivery estimates, tracking availability, shipping costs, destination eligibility, bulk-order procedures, freight requirements, and international-shipping conditions may vary.

Estimated delivery dates are estimates unless a service is expressly identified as guaranteed. Weather, carrier disruptions, customs inspections, agricultural inspections, remote-area conditions, labor disruptions, and other events beyond Sunrise Garden Center's reasonable control may affect delivery.

32. Title, Delivery and Risk

Where legally permitted, delivery is generally considered completed when the applicable carrier records delivery to the shipping address provided by the customer. Higher-value shipments may require signature or other delivery confirmation.

This provision does not prevent a customer from reporting legitimate loss, damage, misdelivery, or non-delivery. Claims will be reviewed according to applicable policies, carrier records, and law.

33. Incorrect Shipping Information

Customers are responsible for entering complete and accurate shipping information. Sunrise Garden Center will make reasonable efforts to assist with address corrections before shipment.

Once a shipment has been transferred to a carrier, an address change may not be possible. Additional costs resulting from an inaccurate address supplied by the customer may be the customer's responsibility where legally permitted and properly disclosed.

34. International Orders

International availability depends on product type, destination, carrier availability, and applicable law. International customers may be responsible for customs duties, taxes, brokerage fees, import assessments, permits, phytosanitary requirements, and similar destination charges unless expressly included in the purchase price.

Sunrise Garden Center does not control customs or government inspection timelines. A destination displayed in a shipping selector does not necessarily mean that every product is legally eligible for import into that destination.

35. Returns and Refunds

Returns, exchanges, cancellations, and refunds are governed by the Sunrise Garden Center Returns & Refunds Policy and applicable law. Customers should review that policy before completing a purchase.

The policy should explain: return eligibility, applicable return period, non-returnable goods, damaged-item procedures, incorrect products, order cancellations, return shipping, refund methods, and expected processing periods. Approved monetary refunds are ordinarily issued to the original payment method whenever reasonably possible.

36. Damaged or Incorrect Orders

Customers should inspect orders promptly after delivery. A customer receiving an incorrect, materially damaged, or incomplete shipment should contact Sunrise Garden Center according to the Damaged Orders Policy or Returns & Refunds Policy.

Photographs, shipping labels, packaging, tracking information, or other reasonable evidence may be requested to investigate the issue. This requirement will not be applied in a manner that unlawfully limits consumer rights.

37. Chargebacks and Payment Disputes

Customers are encouraged to contact Sunrise Garden Center directly regarding legitimate order problems so the issue can be reviewed promptly.

Sunrise Garden Center may maintain transaction and fulfillment records including order confirmations, payment authorization records, customer correspondence, shipping records, tracking data, delivery confirmation, and refund documentation.

Nothing in these Terms prevents a customer from exercising legitimate rights available through a card issuer, payment provider, financial institution, or applicable law. Knowingly filing a fraudulent payment dispute or deliberately misrepresenting receipt of merchandise may constitute misuse of the Website and may be addressed through appropriate lawful channels.

38. Reviews, Ratings and Testimonials

Where Sunrise Garden Center allows product reviews or testimonials, submitted content should reflect genuine customer experiences and must not contain unlawful, defamatory, threatening, discriminatory, fraudulent, infringing, or intentionally misleading content.

Sunrise Garden Center may moderate content for legitimate reasons but should not manipulate reviews in a manner that materially misrepresents customer sentiment. Review counts, star ratings, and testimonials displayed on the Website should correspond to authentic or otherwise properly identified sources. Sunrise Garden Center should not publish fabricated reviews or imply that a review came from a verified purchaser when it did not.

Agricultural and seasonal inventory may be affected by crop conditions, supplier availability, harvest cycles, weather, transportation, regulatory controls, and market availability.

Sunrise Garden Center may modify or discontinue products without advance notice. This does not affect obligations relating to orders already accepted.

62. Customer Responsibility

66. Indemnification for Misuse
